Brazil Senate Committee Approves Sweeping Betting Ad and Sponsorship Restrictions

On Wednesday, the Science and Technology Committee (CCT) of the Brazilian Senate approved Bill 2.470/2026, advancing comprehensive restrictions on advertising and sponsorship across the country’s fixed-odds betting sector. Authored by Senator Damares Alves with a substitute draft prepared by rapporteur Senator Alessandro Vieira, the proposed legislation was granted urgency status for swift evaluation and debate by the full Senate Plenary.

The approved text introduces major amendments to the Brazilian Betting Law (Law 14.790/2023) aimed at consumer protection, mental health safeguards, and preventing household debt. The bill establishes a near-total prohibition on direct and indirect marketing for betting operators across broadcast television, radio, print media, outdoor billboards, streaming platforms, social networks, and internet search engines, as well as algorithmic targeting and direct messaging. Furthermore, the legislation bans bonuses, promotional credits, free bets, cashback, and loyalty rewards designed to acquire or retain players. Betting operators will also be prohibited from entering into sponsorships with sports teams, leagues, broadcasts, cultural projects, and influencers, with existing sponsorship contracts subject to a 24-month phase-out window.

Under the new framework, casino games classified as carrying excessive risk due to rapid random cycles, such as online slots, roulette, and crash games, face prohibition or stringent containment measures. Violations of marketing and compliance standards will fall under existing regulatory penalties with fines reaching up to BRL 2 billion ($392.8 million), alongside a new criminal offense carrying one to five years of imprisonment for promoting unauthorized gambling platforms. For licensed operators, these measures require fundamental restructuring of acquisition channels, while industry analysts caution that sweeping advertising bans could inadvertently drive consumer demand toward unregulated offshore operators.
